1. Introduction

Welcome to Vivapay! These Terms of Use govern your access to and use of our services, including wallet savings, virtual credit cards, Esusu participation, gift card redemption, utility payments, and more. By using our app, you agree to these terms. If you do not agree, please discontinue use of the app.

2. Services Provided

2.1 Wallet Funding

• Users can fund their wallet from overseas to any Nigerian bank account at competitive exchange rates.
• All remittances are subject to compliance with regulatory requirements, including identity verification.

2.2 Viva Piggybank Savings

• Save funds securely using the Viva Piggybank feature.
• Savings terms, interest rates, and withdrawal conditions will be provided in-app and are subject to change.

2.3 Viva Esusu

• Participate in group savings plans (Esusu) with agreed contributions and payout schedules.
• All participants must adhere to the terms of the Esusu group, which will be detailed upon joining.

2.4 Virtual Credit Card

• Users can create and manage their own virtual credit cards for secure online transactions.
• The virtual card service is subject to additional verification and spending limits.

2.5 Gift Card Redemption

• Redeem a wide range of gift cards through the app.
• Redeemed gift card funds will be credited to your account or used for specified transactions.

2.6 Utility, Airtime, and Data Payments

• Pay for utilities (e.g., electricity, cable TV), purchase airtime, and buy data bundles seamlessly.

2.7 Transaction Reversal

• Funds sent to a Nigerian bank account can be reversed if the delay period specified during the transaction has not been exceeded.
• Reversals may incur a fee.

3. User Responsibilities

• Account Creation: Users must provide accurate and complete information, including full name, email, phone number, date of birth, address, and nationality.
• Security: You are responsible for safeguarding your login credentials. Any activity through your account is considered authorized by you.
• Compliance: Users must comply with all applicable laws, including anti-money laundering (AML) and counter-terrorism financing (CTF) regulations.
• Prohibited Activities: You may not use the app for unlawful purposes, including fraud, money laundering, or any unauthorized financial activities.

4. Fees and Charges

• Fees for transactions will be displayed clearly in-app before you confirm any transaction.
• Exchange rates for remittance are determined by Vivapay and are subject to market variations.

5. Intellectual Property

All content, features, and functionalities of the app, including the Vivapay name, logo, design, and software, are the exclusive intellectual property of Vivapay. You may not reproduce, distribute, or modify any part of the app without our prior written permission.

6. Limitation of Liability

Vivapay is not liable for losses resulting from third-party provider failures, unauthorized access to your account due to your negligence, or errors from incorrect information you provide.

7. Termination

We reserve the right to suspend or terminate your account if you violate these Terms of Use or if we detect any fraudulent or unauthorized activity.

8. Modifications to Terms

We may update these Terms of Use at any time. We will notify you of significant changes. Continued use of the app after updates constitutes your acceptance of the new terms.

9. Governing Law

These Terms of Use are governed by the laws of Nigeria and Canada. Any disputes will be resolved in the courts of these jurisdictions.
